1. Terms
By accessing the website (islandflavorcaterers.ca), placing an order online, or visiting our physical location at 3007 Sheppard Avenue East, Scarborough, Ontario, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site or our services.
2. Use License
a. Permission is granted to temporarily view the materials (information, menus, and media) on Stacy’s Island Flavor’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
i. modify or copy the materials (including food photography);
ii. use the materials for any commercial purpose (e.g., using our images for another restaurant), or for any public display (commercial or non-commercial);
iii. remove any copyright or other proprietary notations from the materials; or
iv. transfer the materials to another person or "mirror" the materials on any other server.
b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Stacy’s Island Flavor at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer
a. The materials on Stacy’s Island Flavor’s website and the food products provided are on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties of merchantability or fitness for a particular purpose.
b. Allergen Disclaimer: Our food is prepared in a kitchen that handles nuts, dairy, gluten, seafood, and soy. While we take precautions, we cannot guarantee a 100% allergen-free environment.
c. Availability Disclaimer: Due to high demand, specific menu items (including the Oxtail Stuffed Patty and Oxtail Entrées) are subject to availability and may be sold out. Stock-outs do not constitute a breach of service.
d. Third-Party Delivery: We are not responsible for the condition, temperature, or delivery time of orders placed through third-party platforms (Uber Eats, SkipTheDishes, DoorDash) once the food leaves our premises.
4. Limitations
In no event shall Stacy’s Island Flavor or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the website or our services, even if Stacy’s Island Flavor or an authorized representative has been notified orally or in writing of the possibility of such damage. This limitation specifically applies to catering delays caused by traffic, weather, or parking constraints at our plaza location.
5. Accuracy of materials
The materials appearing on the website could include technical, typographical, or photographic errors. Stacy’s Island Flavor does not warrant that any of the materials on its website are accurate, complete or current. We may make changes to the materials contained on its website (including menu prices and item descriptions) at any time without notice. Prices listed on third-party sites may differ from in-store pricing; in-store pricing prevails.
6. Links
Stacy’s Island Flavor has not reviewed all of the sites linked to its website (including third-party delivery partner pages) and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Stacy’s Island Flavor of the site. Use of any such linked website is at the user's own risk.
7. Modifications
We may revise these terms of service for its website and operations at any time without notice. By using this website or placing an order, you are agreeing to be bound by the then current version of these terms of service.
8. Refund policy
Takeout Orders: We do not offer refunds for "change of mind" once an order has been prepared. If an item is missing or prepared incorrectly, you may ask for a replacement or a refund for that specific item only at the time of pickup.
Third-Party Orders: Refunds for orders placed via Uber Eats, SkipTheDishes, or DoorDash must be processed through the respective app's support system.
Catering: Large catering orders require a deposit. Deposits are non-refundable if the event is cancelled with less than 48 hours' notice.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
